Terms and Conditions of Use of MediaVault

1. Purpose

These Terms and Conditions govern access to and use of the MediaVault tool, jointly managed by the Fundación Maldita.es contra la desinformación: periodismo, educación, investigación y datos en nuevos formatos and Full Fact (hereinafter, "MediaVault").

MediaVault is a system that collects manipulated images and videos shared globally and analyzed by recognized fact-checking organizations. The MediaVault archive allows fact-checkers to preserve an essential part of their work and facilitates faster research, as well as the identification of patterns used in misleading social media posts.

By using MediaVault, the user fully accepts these Terms and the Privacy Policy, and agrees to use the service appropriately in accordance with applicable regulations.

2. Access to the Service

Access to the MediaVault tool is free of charge and granted exclusively to organizations and professionals engaged in fact-checking, who have registered on the platform upon request via the corresponding form.

MediaVault may approve or revoke access without the need for justification, especially in cases of misuse or breach of these Terms.

In the event of revocation of access to the service, all provisions of these Terms and Conditions that, by their nature, must survive shall remain in effect, including, but not limited to, those relating to ownership, warranty exclusions, indemnities, and limitations of liability.

3. User Registration and Service Use

Only organizations, entities or professionals engaged in fact-checking may register and use the platform. Users may register through forms enabled by MediaVault on the website, which must be completed with complete and truthful information, and accept these Terms and Conditions by clicking the submission button at the end of the form.

Once the registration is submitted, MediaVault will review the information provided to verify the identity and affiliation of the applicant.

The user will be provided with a username and password to access the platform. These credentials are personal and confidential, and the user must keep the password safe and inaccessible to unauthorized third parties.

Once the user is registered and their identity verified, a user account ("MyVault") will be created, through which the user may access MediaVault services by logging in with their username and password, and access their personal data, which must be kept up to date.

Registered users may:

  • Verify the truthfulness or falsity of content and information.
  • Download structured content in ClaimReview and MediaReview formats.
  • Upload and archive specific verified media pieces.
  • Consult the archive shared by other authorized users, provided those users have marked them as visible.

Use of the service must comply with applicable law. Uploading content that includes non-public personal information, confidential or illegal content, or using the platform for purposes other than fact-checking and disinformation analysis is prohibited.

4. Data Protection

Personal data of registered users collected through the tool will be processed by Maldita.es (contacto@maldita.es) and Full Fact (mediavault@fullfact.org) as joint controllers. Such data will be processed for the following purposes:

  • Management of the tool and its functionalities.
  • Access, content, and infrastructure control.
  • Facilitation of service use and administration.
  • Handling of deletion or objection requests.

The legal basis for processing is the contractual relationship established by the acceptance of these Terms and Conditions regulating the use of MediaVault.

5. User-Uploaded Content

Users may add content to MediaVault for the following purposes: (i) to verify potentially false, incorrect or manipulated content or information, or (ii) content previously verified by media outlets. Such content (e.g., links, files, fact-check classifications) may be visible to other authorized users depending on the visibility settings defined by the uploading user.

In any case, uploading personal data or content that infringes third-party intellectual or industrial property rights is prohibited. If personal data are included, the user must ensure compliance with data protection regulations and confirm they are authorized to share such data through the platform.

MediaVault does not guarantee prior review of uploaded content but reserves the right to suspend or delete content that breaches these Terms, the platform's content usage rules, or current legislation.

Any media uploaded by a user may be retained to support our disinformation research. Uploading non-public personal data or any material that may violate the laws of the user's country, state, city, region, or municipality is not permitted.

6. Termination

We may terminate or suspend access to our Services immediately, without prior notice or liability, for any reason, including, but not limited to, breach of these Terms.

All provisions of these Terms that by their nature should survive termination shall remain in effect, including, but not limited to, ownership, warranty disclaimers, indemnity, and limitations of liability.

7. Intellectual Property and Reuse

Unless prior written authorization is obtained, redistribution of downloaded content from MediaVault and the use of the service to develop commercial products based on the obtained data are strictly prohibited.

8. Obligation to Cite

The user agrees to appropriately mention MediaVault and its joint controllers (Maldita.es and Full Fact) in any publication using data or content downloaded from the tool, including articles, reports, research, presentations, etc.

9. Limitation of Liability

MediaVault does not guarantee the continuous and uninterrupted availability of the service and is not liable for damages resulting from misuse, technical interruptions, data loss, or unauthorized access.

We guarantee that we own MediaVault and all its components and that we have and will retain full power and authority to grant the intellectual property and other rights granted under these Terms and Conditions without the additional consent of third parties.

Our service may contain links to third-party websites or services not owned or controlled by MediaVault, as well as embedded media files collected from such websites or services. The collection of these files is authorized under the fair use doctrine.

We have no control over, and assume no responsibility for, the content, privacy policies, or practices of third-party websites or services. Furthermore, the user acknowledges and agrees that MediaVault shall not be liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available through any such third-party websites or services.

If the user uses the tool in breach of these Terms or if the information and content added by the user violates data protection regulations, third-party intellectual or industrial property rights, or any applicable law, the user shall be solely responsible for any resulting damage, including without limitation any sanctions imposed by competent authorities.

10. Modifications

These Terms may be updated or modified to reflect legal, technical, or functional changes. Registered users will be notified sufficiently in advance, and continued use of the service will constitute acceptance of the new terms.

11. Applicable Law and Jurisdiction

These Terms and Conditions shall be governed by Spanish law.

In the event of a dispute, the parties shall preferably submit to the courts of the city of Madrid (Spain), without prejudice to the applicable legislation and competent supervisory authority based on the user's country.
